    ORDER CONFIRMING WITHDRAWAL OF APPEAL AND RETURN OF FINAL PROGRAM REVIEW DETERMINATION


    On August 25, 1994, the Branch Chief of the Institutional Review Branch, Field Operations Service, Office of Student Financial Assistance Programs (SFAP), U.S. Department of Education, issued a Final Program Review Determination against Respondent. Respondent filed a Request for Review on October 5, 1994. Respondent sent the tribunal a letter dated January 17, 1995, in which he stated that the school wished to withdraw its appeal of the final program review determination.

    Respondent's letter is accepted, and will be treated as Respondent's withdrawal of its request for a hearing to demonstrate that the expenditures questioned or disallowed were proper and that the institution complied with program requirements. See In the Matter of Philadelphia Training Center Corporation and Affiliates, Dkt. No. 94-22-ST, U.S. Dep't of Educ. (Order Confirming Withdrawal of Appeal and Return of Notice of Intent to Terminate) (June 24, 1994).

    Accordingly, this case is returned to the Acting Director of the Institutional Monitoring Division, SFAP, for further action in accordance with the Final Program Review Determination dated August 25, 1994.
