DECISION


    On November 28, 1994, the tribunal conducted an emergency action hearing in the above- captioned proceeding. At the hearing, counsel for SFAP stated that the Department's Compliance and Enforcement Division had not initiated a termination action against Respondent within 30 days of initiating the emergency action proceeding on October 26, 1994. Pursuant to 34 C.F.R. § 668.83(f)(1), the emergency action has expired and is no longer in effect. As a result, the tribunal is without jurisdiction in this matter.

    Accordingly, the above-captioned proceeding is DISMISSED.
